Terms of Service

These Terms of Service (“Terms”) govern your access to and use of ThetaFuel websites, apps, and related services (the “Services”). By accessing or using the Services, you agree to these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

1. The Services

ThetaFuel provides tools related to athletic and performance coaching, content delivery, scheduling, and optional integrations with third-party services such as Google Calendar and Gmail. Features may vary by organization, role, and configuration.

2. Accounts and access

Access may require a login code or other credentials issued by your organization or by us. You are responsible for keeping credentials confidential and for activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or revoke access to protect the Services or other users.

3. Acceptable use

You agree not to:

• Misuse the Services or attempt to disrupt or gain unauthorized access
• Use the Services for unlawful, harmful, or fraudulent purposes
• Upload or transmit malware or abusive content
• Scrape, reverse engineer, or circumvent security or access controls except where permitted by law
• Use connected third-party accounts in ways that violate those providers’ terms

4. Scheduling and bookings

Scheduling features allow users to view availability and create bookings. You are responsible for the accuracy of information you submit. Booking confirmations, cancellations, and calendar invites (including Google Calendar events and reminders when enabled) depend on system configuration and third-party services. We do not guarantee that every notification will be delivered or received.

5. Third-party services

The Services may integrate with third parties (including Google). Your use of those services is subject to their own terms and privacy policies. We are not responsible for third-party services or for changes they make that affect integrations.

6. Intellectual property

ThetaFuel and its licensors own the Services, including software, branding, and content we provide. You receive a limited, non-exclusive, non-transferable right to use the Services as permitted by these Terms and your organization’s agreement with us. You retain rights to content you submit, and you grant us a license to host and process that content as needed to operate the Services.

7. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ThetaFuel is not a substitute for professional medical, psychological, or other licensed advice. Performance and coaching outcomes are not guaranteed.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THETAFUEL AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU (OR YOUR ORGANIZATION) PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

9. Indemnity

You will defend and indemnify ThetaFuel against claims, damages, and expenses arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

10. Changes

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. Continued use after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Services.

11. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services ends, though sections that by nature should survive (including disclaimers and limitations) will survive.
